TERMS OF SERVICE: NIFTY DRIVER & NIFTY TAXI
1. Introduction, Scope & Acceptance
Welcome to Nifty Driver, an Irish-owned and operated technology platform. These Terms of Service (“Terms”) govern your access to and use of the Nifty Driver website, mobile applications, and the marketplace (collectively, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must cease use immediately. These terms are designed to protect your privacy and consumer rights in accordance with the Irish Data Protection Acts 1988-2018, the GDPR, and the Consumer Rights Act 2022.
2. Nature of Service: Technology Provider Status
Nifty Driver is a technology company, not a service provider.
- Intermediary Role: The Platform acts strictly as an intermediary marketplace that connects independent drivers (“Drivers”) with third-party individuals or businesses seeking transport or driving services (“Customers”).
- No Employment: Nothing in these Terms creates a relationship of employment, agency, joint venture, or partnership between Nifty Driver and any Driver. Drivers are independent contractors responsible for their own tax, social insurance (PRSI), and operational expenses.
- No Transport Services: Nifty Driver does not provide transport, taxi, or logistics services. All such services are provided by the independent Drivers who are not employees or agents of Nifty Driver.
3. User Responsibility & Due Diligence
Because Nifty Driver is a marketplace, the responsibility for safety and suitability rests with the users:
- Customer Due Diligence: Customers acknowledge that they are solely responsible for performing their own due diligence before hiring or engaging a Driver. This includes, but is not limited to, verifying the Driver’s identity, checking physical licenses, and interviewing the Driver to ensure they meet specific requirements.
- Informed Decisions: Any engagement, contract, or agreement entered into between a Customer and a Driver is an informed decision made independently by the users. Nifty Driver is not a party to any agreement between Users.
- Verification Disclaimer: While Nifty Driver may provide tools for Drivers to upload credentials, Nifty Driver does not guarantee the authenticity, validity, or accuracy of any information provided by Users on the Platform.
4. Driver Eligibility & Nifty Taxi (SPSV)
To maintain an account on the marketplace or the Nifty Taxi dual-app, Drivers must comply with Irish law and National Transport Authority (NTA) regulations:
- Licensing: Drivers must hold a valid Irish Driving License. For Nifty Taxi services, Drivers must hold a valid Small Public Service Vehicle (SPSV) Driver License and ensure the vehicle used is a licensed SPSV.
- Insurance:Drivers are strictly required to maintain active "Hire and Reward" commercial insurance. Nifty Driver does not provide insurance coverage for trips or jobs arranged via the Platform.
- Compliance: Drivers agree to adhere to all NTA regulations, including those regarding metered fares, vehicle standards, and driver conduct.
5. Payments, Security, and Fees
- Payment Processing: All financial transactions, including booking fees, job deposits, or fares, are managed securely by third-party partners (e.g., Stripe or Revolut).
- Data Security: Nifty Driver does not store full credit card details on its local servers.
- Taxi Fares: For Nifty Taxi services, fares must be calculated via the regulated taxi meter in accordance with NTA statutory fair scales.
- Refunds & Cancellations:Under the Consumer Rights Act 2022, a 14-day "cooling-off" period may apply to digital subscriptions. However, if a specific service or job has been initiated or "prepared" within this window, the right to a refund may be waived or limited.
6. Conduct, Damages, and the "Photo Rule"
- Standard of Conduct: All users must act professionally and legally. Nifty Driver reserves the right to ban any user for reported misconduct.
- The Documentation Rule: To protect both parties in the event of a dispute regarding a vehicle or equipment, users are encouraged to take timestamped photos at the start and end of a job. These photos will serve as primary evidence in any dispute resolution.
- Soiling & Damage:In the context of Nifty Taxi, passengers may be liable for a "soiling fee" (up to the NTA maximum of €140) if they damage or soil a Driver’s vehicle.
7. Limitation of Liability
To the maximum extent permitted by Irish law, Nifty Driver shall not be liable for:
- Any physical injury, property damage, or financial loss arising from a connection made on the Platform.
- The conduct, actions, or omissions of any Driver or Customer.
- Any service interruptions, technical errors, or inaccuracies in user-provided data.
Indemnity: Users agree to indemnify and hold Nifty Driver harmless from any claims, losses, or legal fees resulting from their use of the Platform or breach of these Terms.
8. Data Privacy & Rights
- Data Controller: Nifty Driver is the data controller. For queries, contact Info@niftydriver.com.
- Usage: We process your location and profile data to facilitate the marketplace. We do not sell your personal data.
- Sharing: Data is shared only with necessary technical partners (Mapping, Payments, Cloud Storage).
- Rights: You have the right to access, rectify, or request the deletion of your data (Right to be Forgotten).
9. Intellectual Property
All content, branding, and software code on the Platform are the property of Nifty Driver or its licensors. You may not copy, redistribute, or reverse-engineer any part of the Platform without express written consent.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ireland.
11. Regulatory Oversight
If you believe your data rights have been breached, you have the right to lodge a complaint with the Irish Data Protection Commission (DPC):

Recommended "Due Diligence" Checklist for your App's UI
To support these terms, you should display this checklist to Customers when they book a driver:
- Verify Identity: Check that the driver matches their profile photo.
- Check License: Ask to see a physical Driving License or SPSV badge.
- Confirm Insurance: Ensure the vehicle has a valid insurance disc displayed.
- Confirm Fees: Agree on the job rate or ensure the meter is used for taxi trips.
